Introduction and Acceptance of Terms
Welcome to Kirkify AI, an AI-powered image creation, video generation and photo enhancement service. By accessing or using our service, you agree to these Terms of Service. If you do not agree, please do not use the service.
Use of the Service
Kirkify AI lets users create images and videos, enhance photos and apply creative effects. You agree to use the service only with content you have the right to use and in accordance with applicable laws and platform rules.
AI Models Used
Create Image / Image Studio offers models including GPT Image, Nano Banana (Gemini), Seedream, FLUX, Qwen Image, Wan Image, Z-Image, Grok Imagine and Midjourney. Video Studio offers models including Veo, Kling, Seedance, Wan, Hailuo, Vidu, Sora and Grok Imagine. Each generation uses the specific model selected in the generator.
Big Smile uses Nano Banana Ext. Image Enhancer uses Nano Banana Pro (Gemini 3 Pro Image). Prompt optimization uses Gemini 2.5 Flash Lite. These model and variant names do not imply that Kirkify AI trained or owns these models.

User Accounts and Registration

Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Content and Intellectual Property Rights
The Kirkify AI website, branding, interface, and underlying service are protected by applicable intellectual-property laws. You retain rights in content you upload, subject to the rights needed for us and our processing providers to operate the requested generation.
Community Showcase License and Consent
Generated results are not placed in the public Community Showcase by default. If you actively opt in, you grant Kirkify AI a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, and publicly display that generated result for the Community Showcase and related promotion of Kirkify AI. This license ends when you withdraw the result, except for limited copies we must retain for legal, security, or consent-record purposes.
When opting in, you represent that you own the submitted image or have all permissions needed to authorize public display of the generated result, including permission involving any depicted private individual where applicable. We may decline or remove showcase content for safety, legal, moderation, or product-quality reasons.
Prohibited Activities
Acceptable Use and Content Safety
The following rules apply to prompts, uploaded reference media, generated images and videos, public creations, and comments. Do not request, upload, create, or publish:
- Pornography / NSFW: sexually explicit content, sexual exploitation, or non-consensual intimate imagery.
- Violence / gore: graphic mutilation, glorification of violence, threats, or content encouraging harm.
- Hate speech: content promoting hatred, dehumanization, or violence against protected groups.
- Child-unsafe content (CSAM): sexualized depictions or exploitation of minors, including synthetic depictions and attempts to disguise a minor's age.
- Deepfakes / impersonation: deceptive impersonation, fabricated evidence or endorsements, non-consensual intimate transformations, or use of a person's likeness to harass, defraud, or mislead. Describing an image as parody does not override consent, privacy, or applicable law. Do not present AI-generated media as authentic footage or an actual statement by the depicted person.
- Copyright / trademark infringement: content you lack the necessary rights to use, infringing logos or characters, or false affiliation with a person, brand, or model provider.
AI outputs may be inaccurate or change a person's appearance. Disclose that results are AI-generated when sharing them. A model's availability is not permission to bypass these rules.
Reporting and Appeals
Report suspected violations or rights concerns to [email protected]. Include the creation URL or task ID, the reason for the report, and a way to contact you. Do not email illegal imagery or unnecessary identity documents; a URL or identifier is sufficient for the initial report. We review reports and may request additional relevant information. To appeal a removal or restriction, use the same address with the subject “Content appeal” and explain the decision you dispute.
We may refuse processing, remove public content, or restrict access where necessary to enforce these rules. These actions do not remove statutory consumer rights. We do not promise automatic forfeiture of purchased credits merely because a report is received.
Current Review Limitations
Generation providers may apply their own safety checks. Public comments are subject to approval before display. Neither of these controls means that every image or video has passed a platform-side safety review. We are improving our cross-model prompt and output moderation; this policy is not a claim that comprehensive automatic screening is already deployed. Report potentially unsafe content through the channel above.
You agree not to engage in any of the following prohibited activities while using Kirkify AI:
- Uploading content without the necessary rights or consent
- Using generated media to deceive, harass, defame, or impersonate others
- Interfering with or disrupting the security or performance of the service
- Using the service for any illegal or unauthorized purpose
- Attempting to bypass any security features of the service
Privacy and Data Collection
Kirkify AI collects the following types of data:
- Account Information: Information you provide when creating an account
- Usage Details: Data related to your activity on our service
- Device Information: Information about the device you use to access our service
- Cookies: Data that helps us enhance your experience with our service
- Payment and Billing Information: Data necessary to process payments

Pricing and Payments
- All purchases are final and non-refundable unless otherwise required by law
- Prices are subject to change with notice to users
- You agree to pay all charges associated with your selected plan

Termination
We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.
Disclaimer of Warranties
The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, Kirkify AI shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service.
Indemnification
You agree to indemnify and hold harmless Kirkify AI and its service providers from claims arising from your misuse of the service or violation of these Terms.
Governing Law and Dispute Resolution
These Terms are governed by applicable law. Any dispute will be handled by a competent court or another dispute-resolution method required by applicable law.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
